2. Guide Description

LanguageTravelAndGoodDeals.com offers a digital guide designed specifically for owners of holiday cottages, vacation rentals, guesthouses, hotels, and other tourist accommodations, to simplify the travelers' experience. This guide includes access via a QR code and/or a URL, enabling users to consult the information anytime on their devices. The guide includes:

• Standard Version: Practical guide with fully interactive GPS information: access the best places to visit between Paimpol and Trégastel with just one click, including must-see sites, beaches, markets, local events, special deals, as well as essential services like public restrooms, free parking, and ATMs. Information is regularly updated to ensure relevance throughout the year.
• Premium Version: A personalized guide (including the standard guide + an additional A4 page with personalized information such as the name of the rental in the title, Wi-Fi code, specific rental instructions, heating and air-conditioning guidelines, appliance and barbecue instructions, emergency contacts, safety advice, and tailored recommendations). Any requests exceeding these limits will be subject to a separate quote.

3. Pricing and Payments

Individuals

Standard Version

• First Year: €168/year, including access to the guide in PDF format, a QR code plaque with a plastic stand (dimensions: 18x13 cm, Shipping in addition and via La Poste), in French, English, and German, technical support during the license period, and updates. PDF only: €150/year from the first year.
• Renewal: €150/year, including access to the guide in PDF format, technical support during the license period and updates.

Premium Version

• First Year: €198/year, including access to the guide in PDF format, a QR code plaque with a plastic stand (dimensions: 18x13 cm, Shipping in addition and via La Poste), in French, English, and German, technical support during the license period, and updates. PDF only: €180/year from the first year.
• Renewal: €180/year, including access to the guide in PDF format, technical support during the license period and updates.

All invoices will be issued in the name of ADaptKonnex. Payment is due in full before the guide is provided. Payment Methods: Bank transfer - Check - Payment via PayPal (upon request). The license is activated once payment is received. The QR code and access URL are sent to the client within 48 hours of payment confirmation. The license is valid for 12 months from the date of payment reception.

4. Guide Delivery and Access

The guide is delivered in digital format via a QR code. An alternative URL, accompanied by a username and password, is also included on the plaque provided to the client in case of technical issues.

The license is valid for 12 months from the date of purchase. It must be renewed annually to maintain access to the guide.

5. Terms of Use

Liability

The Service Provider endeavors to provide accurate and up-to-date information, based on public data or local partnerships. However, the Service Provider does not guarantee the accuracy, completeness, or real-time updating of this information. Consequently, the Service Provider cannot be held liable for any errors, omissions, or outdated information in the guide, GPS links, or any other provided content.

The use of GPS links, practical information, and any other content provided in the guide is entirely at the user's responsibility. The Service Provider disclaims all responsibility for misuse, incorrect data, or incidents resulting from the use of this information, including errors in location, routing, or access.

When external links or third-party sites are provided, the user is redirected to these sites at their own risk. The Service Provider does not control these third-party sites and disclaims all liability in the event of hacking, intrusion, or other technical or security incidents affecting these sites. The user is advised to review the terms of use and privacy policies of these third-party sites before interacting with them.

Furthermore, the user acknowledges that the information in the guide is subject to change without notice and that it is their responsibility to verify the relevance and accuracy of the data before use.

Personal Use and Ownership Clause

The provided guide is intended for strictly personal and non-commercial use. As a user, you agree not to reproduce, distribute, broadcast, transmit, publish, sell, sublicense, modify, or create derivative works from this guide without prior express written authorization from the publisher. Any unauthorized total or partial reproduction, redistribution, public availability, or resale constitutes a violation of copyright and intellectual property rights associated with the guide.

The user also agrees not to use this guide for commercial purposes, such as integration into products or services intended for resale or sharing for free or for a fee.

The user is granted only a non-exclusive, non-transferable, and non-sublicensable license.

Any non-compliant use will result in legal sanctions, including but not limited to lawsuits for copyright infringement.

6. Right of Withdrawal

In accordance with the provisions of Article L221-28 of the Consumer Code, the consumer expressly waives their right of withdrawal for the supply of digital content (digital guide, platform access, etc.) as soon as contract execution begins, i.e., as soon as the QR code or URL provided on a physical support (minimum 120g paper in a plastic stand), accompanied by the username and password, is used to access the digital content.

Although the QR code is printed on physical support, the delivered content remains digital, and access to the guide is obtained solely through the use of this code or the provided URL. Consequently, once access to the digital guide is obtained, the consumer waives their right of withdrawal.

The consumer expressly waives their right of withdrawal, in accordance with Article L221-28 of the Consumer Code, as soon as access to the digital content (guide, QR code, URL) is activated.

Payment for the order constitutes acceptance of these Terms and Conditions, including the waiver of the right of withdrawal.

7. Limitation of Liability

• No Guarantee of Outcome: The Service Provider does not guarantee that the use of the information provided in the guide will fully meet the user's expectations. Any consequences arising from the use of this information are the sole responsibility of the user.
• GPS Links and Information: GPS data, practical information, and recommendations are provided for informational purposes only. The Service Provider cannot be held liable for any errors, omissions, changes, unavailability, or deletion of this data. Users are advised to verify its accuracy before use.
• External Websites: Some links included in the guide may redirect to third-party websites. The Service Provider exercises no control over these sites and disclaims all liability regarding their content, availability, privacy policies, or any damage or loss resulting from their use.
• Force Majeure: The Service Provider shall not be held liable for delays or non-performance resulting from circumstances beyond their control, such as technical problems, cyberattacks, or force majeure events.

Under no circumstances shall the Service Provider be held liable for indirect losses, such as loss of profits, data, or opportunities resulting from the use of the guide or its services.

8. Collection and Processing of Personal Data

No personal data is collected from end users of the guide.

The only personal data collected are those strictly necessary to issue the invoice for customers who purchased the guide (name, first name, billing address, email, and, if applicable, phone number). These details are used exclusively for order management and to meet legal obligations related to invoicing.

These data are not shared with third parties, except in cases of legal obligation or with the explicit consent of the customer.

In accordance with applicable regulations, personal data collected are retained only for the duration necessary to meet legal and tax requirements. After this period, they are securely deleted.

The Service Provider is committed to protecting the confidentiality of the collected personal data and not sharing it with third parties without prior consent, except in cases of legal obligations.

9. Dispute and Consumer Mediation

In case of a dispute between the Client and the company, they will attempt to resolve it amicably (the Client will send a written complaint to the professional or, where applicable, to the Professional's Customer Relations Service).

If no amicable agreement is reached or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer client, as defined in Article L.133-4 of the Consumer Code, has the possibility to refer free of charge, if a disagreement persists, to the competent mediator listed by the Evaluation and Control Commission of Consumer Mediation under Article L.615-1 of the Consumer Code, namely:

10. Launch Date and Copyright Protection

The digital guide was launched and made available for sale starting January 1, 2025. This date marks the beginning of the product’s availability and its protection by copyright.
